United physically removing paid passenger from plane

    Wow, at least you didn't have to resort to insults to get your point across. As has been pointed out a million times, the airline was in its rights to remove the passenger. The police told him to get off. He refused. He is on private property. While I hate to see how this ended up, the passenger bears some responsiblity.

    BTW, reading is a skill. Master it. If you had bothered to read my post, it said I workED for an airline 20 years ago. Note the ED, which is past tense, and the 20 years ago, which gives a time frame. So yes, I am doing great at my job, although it has nothing to do with an airline. I also did just fine when I worked for the airline, however it was just a job while in college, not a career .

    That never happens. If you were a loyal United customer, would you honestly tell me that you are going to stop using them, because some pinhead didn't want to follow a directive? People get re-assigned at airports every day. The thing is, the very large majority don't act like a baby, and throw a fit. Had he walked off the plane, none of us would have ever heard a peep about this.

    This is very true. And this law was written for and by the airlines to screw passengers with little recourse on our ends.
    Also, I am afraid of the people who blithely sign off on state violence against the peaceful. Its chilling.

    So, that's the answer? You ignore the airline's pleas long enough, and they will move on to the next rube? Then let's all do that! They can't make anyone leave, and we all just sit there for eternity.

    No. What I meant was that it's the airline employees' job to deal with that, not the police officers'. Airline decides who leaves, not the police.

    I'm sure the loyal customers will still fly. But there are those of us that shop around and won't even look at United fares at least for the present. Of course this will all settle down eventually.

    United did not handle this well. Just because you can do it doesn't make it the wisest choice and the best decision for your bottom line.

    At first, I believed that the airline was well within its rights, and that the cops over reacted to the situation.

    However, this article posted as a response to United's own statement on the situation makes a strong argument against United, using the airline's own COC...

    Under a federal rule [14 CFR 253], commercial airlines are governed by a document known as a “Contract of Carriage” [COC], a legally binding contract which, among other things, protects the legal rights of passengers, and imposes legal duties upon carriers. United’s COC contains two distinct sections: Rule 21 entitled “Refusal of Transport,” and Rule 25 entitled “Denied Boarding Compensation.”

    In brief, according to Rule 25, the airline can only deny boarding at the gate, and not when a passenger has already boarded.

    The second rule United is citing is Rule 21, or "Refusal of Transport", which clearly cites the reasons the airline can remove a passenger from the aircraft...

    Finally, it appears that United is seeking to blame the passenger, claiming that when asked to give up his seat, he acted belligerently – and citing a rule which requires that passengers obey the orders of the flight crew. But, such a requirement applies only to orders which are lawful.

    Once someone in possession of a valid ticket has been seated – whether on an airplane, a train or bus, or at the symphony – he cannot be ordered to give up that which he has a valid contractual right to enjoy, simply because his seat is needed for someone else.

    While it is of course permissible to remove a seated person is such a situation for unruly behavior, drunkenness, to deal with a medical emergency, etc. – as spelled out here in United’s Rule 21 – simple over booking can only be dealt with by denying boarding originally, pursuant to United’s Rule 25.


    It now seems to me that the United staff had a deep misunderstanding of their own rules and regs and are to blame for this entire mess. The enforcers they called have no interest in the airlines rules and regulations.. in fact in these times their mentality is most likely point and shoot. Their actions may have been extreme, but it was the United gate staff that messed up.

    Ultimately, the final decisions will be determined in a court of law, but I do enjoy clarity and would be interested in others opinions about this article. The arguments and justifications for the author's positions are clearly laid out in the article.

    'Working it out' means doing whatever it takes to get someone to volunteer....not talking to him for 3-4 hours. I'm sorry if I didn't make that clear.

    The news today stated that the plane was not overbooked. That the 4 crew workers showed up after all the passengers were on the plane and seated. They needed 4 seats.

    The Doctor's wife volunteered to get off the plane along with 2 other passengers.
    The Asian doctor said he needed to stay because he had appointments with his clients on the next day.

    When the Chinese in China saw the video of a Asian man being forced and his blood on his face they decided to sell their stock. That vicious airline lost 500 million dollars from the Chinese investors.
    I think they will be losing more money from other investors too from other countries.

    A lawyer in the news said that man has a 100% chance of winning his case against the airline.
    I hope the airline settles out of court so that tramatized man can move on in his life. A court case
    will create more drama and mental pain for the injured man.

    If that airline starts to offer us flights for $25.00 a seat with no luggage charge then we can all fly to
    La Vegas! I have flown on other airlines for $25.00 a few years ago.

    If I am ever asked to give up my airline seat from any airline I will ask for a $1,000. I am not greedy and will be happy with that amount. LOL.

    Since I last posted an opinion on this issue, more information has been brought out....The flight wasn't overbooked, United needed to get a 4 member flight crew to another airport ASAP. In any case United had every legal right to remove 4 passengers to accommodate getting the flight crew wherever. Reading Grid's post above answers my question Why the Dr's wife took the offer and he didn't...He did take the offer and then changed his mind.??? Once the good doctor (whose credentials are in question) 'Changed his mind' and was escorted OFF the plane and then RAN back onto the plane; throwing a super HISSY FIT...he received everything he deserved. At the point where the police EXPLAINED to the doctor exactly what was going to happen IF he refused to exit the plane and he CHOSE to continue his hissy fit, he got everything they promised him.
    To all those posters that condone his 'Resistance to POLICE AUTHOURTY' all I can say is you reap what you sow. Civil Disobedience is a legal right...so is it legally right to cut off a tractor trailer who doesn't YIELD to your right of way as you merge onto an entrance ramp...You can end up being DEAD RIGHT. I'm sure St Peter will pat you on your back and agree with you being Right as you enter the pearly gates.

    Yes, I heard about him having a criminal record. So what! The video saw him being abused by cops.
    So it is okay to hurt people because they have a criminal records?
    That man was a victim because those 4 crew workers showed up at the last minute and knew the airline would dump 4 paid passengers off the plane.

    So now we are all going to BLAME THE VICTIM?? Not ME! He paid for his seat and he was already seated and he was totally abused by the airline who called the cops who dragged him out of the plane.
    That is how I see it. We all have strong opinions and I have mine too.

    They did do this. They up the compensation to $1000. No one wanted to take it. It appears part of the problem was the way the situation was communicated - some passengers reported the FA on the intercom has a surly tone. In addition, it looks like it was the last flight out on a Sunday and I am sure most passengers had some Monday obligation that would have made a extra night away from home a difficulty. I appreciate that United didn't want to cancel a flight because they didn't have a crew in position but there seem to be a lack of consideration for the inconvenience the bump would have made for their passengers. It may have not been as expensive as a canceled flight but they were asking a lot of their paying customers.

    So excessive that the City Council is now refusing to arm the airport police. Can you imagine if guns had been in the mix?
