Room comped cancelled by host. (She doesn't even work at that property)

    I have searched this whole board looking for topic. Not discussed. So here it goes.

    I've been gambling at a local chain casino for years. Different ones. I have had the the highest level card before. As well as the second highest card for several years.

    Rarely have i won there, if ever. Years of losses. Don't deal with hosts until i lose a few thousand.

    Used to play at one property. Had a horrible host. She would always bug me for not playing enough. Well marketing sends offers so I'm taking them was always my answer. Finally gave up playing there.

    Played at other properties for years. Now here we are. I make a reservation for 2 comp nights through casino marketing. Have confirmation and email.

    I look at my email a few hours later. See a cancellation. Sorry u won't be able to make it. Here's your cancellation code. Say what? So i called. Reservation agent like that's odd. Puts me on hold.

    Well he comes back. Says it seems as if a casino host has flagged your reservation in the system. He says u will have to talk with her. I can't stand her, as she has been harassing me for years at other property. Fyi she doesn't even work at this property where i had confirmed reservation.

    Thoughts, comments. I am so frustrated. Would like to take legal action.

    That doesn't make any sense. I doubt any casino will allow an ex employee to allow access to their reservations system. It may have been flagged by another host at the property. I'd call and speak with one of the hosts at that casino and find out what the deal is. I'm sure you'll find the old host doesn't have anything to do with this. Unless this is at a CET property, then she technically does work for them... then I'd ask to speak to a supervisor.

    She still works at other property in same company. Just not the one I had reservation at.

    The agent specially said this host has flagged your reservation. I know her speil. Not playing enough. I can't stand her. Well then don't send offers if my play doesn't warrant it.

    Not a Cet property.

    I think this posted in wrong category. How do i move it to be under comps?

    Ah... then I would definitely call and speak with a supervisor at the casino you are wanting to visit and ask to be assigned a new host because of the reasons you spoke about above.

    What casino/chain is this?

    I have a host at this property already. He doesn't bother me at all.

    She doesn't even work at this property. I don't see how she even saw reservation

    I have used a lot of offeres in the past with no play.However, just last month i earned 15,000 points in one day.

    I agree. She harassed me for years at the other property where she works. Always calling, not playing enough. I didn't ask u for comps lady. She is so ridiculous.

    Yes that is their way of helping in any legal matter I'm sure.

    Id so wanna sue for money lost there after being treated like this by her. As Judge Judy says a lawsuit is to make u whole again. Id just want money back I've lost their over the years. Nothing more.

    I know this probably sounds harsh to some. But i feel so harassed by her. She had no business canceling my reservation.

    Unfortunately you have no chance of winning a lawsuit to recover the money you lost there over the years - that isn't what "making you whole" means. Gambling is considered entertainment - you are not guaranteed any wins when you play, and all of those trips you took and the money you spent on gaming was of your own free will. You were "entertained" while you played there, whether you lost or not, so no judge is going to give you back what you have spent. If a casino employee held a gun to your head, forced you into a car and made you gamble there you would have a case, but no judge will refund you what you have lost playing willingly - otherwise we would ALL be in court getting our money back.

    As for harassment by this host, that is another story. I don't know if you can sue for harassment, but you should contact the office of someone at the Corporate level at the company that owns the casino - the President or CEO - and explain what one of their employees has been doing to you. Some sort of disciplinary action against her is warranted, especially since she is not even your host and is obviously specifically checking the system for your name in order to mess with you. If she is doing that to you I am sure she is doing it to other customers as well.

    The OP has no legal claim for anything, not just losses through the years.

    I admit, my BS meter is high on this one. The OP is not revealing which company or resort it is (other than to say it is not CET), joins the Board yesterday with a username of "frustrated", and in a decade and a half of visiting casinos I have never heard a story even remotely close to this scenario

    Without getting into the veracity of the OP and believability of the story, I'll say this...

    Take a bit of free legal advice from an attorney, you have no cause of action against the Casino. You won't get your losses back, those aren't "damages" with respect to this incident. While your treatment from the host on its face sounds unfair and frustrating it doesn't rise to the level of harassment. The only cause of action you could even really make a facial case for (although its still a losing argument) is breach of contract. Without getting into legalities, casino offers don't generally create legal contracts and there is undoubtedly a disclaimer with regard to the comp that defeats your claim anyway. Even if you could establish the existence of a contractual relationship and subsequent breach your only remedy would be with respect to that particular breach (this comp) - either enforcing the offer or compensing you for out-of-pocket expenses due to the breach (note: not gambling losses, but what you paid for the same room that otherwise would have been comped). You have a legal duty to mitigate your damages, so start at the easiest solution - call your current host at the property in question and ask him to resolve the matter. If that doesn't work, then speak to a supervisor.

    My guess is either there is something else going on with your account you are unaware of or not divulging, or the actions of the host will be canceled and the host reminded of her proper role.

    Well there you go. You have taken offers and no played them and now you are flagged. Some clubs can take months before updating offers with recent trends.

    Sometimes thats bad, like when you play strong and have to wait for your higher play to hit the corporate level for offers. If that happens you can hit a host to speed things up.

    Or, in your case, your past play got you decent offers, and you basically stole them without giving them any play. If you are still getting offers reflective of your higher past playing days, even though you are now cashing in the offers and stiffing them, it looks like your host stepped in and flagged your account. So she alerted them to your tendencies of taking without playing since the corporate offers have not caught up to your recent "no play" stays.

    If you never had a host I'm sure you could have flied under the radar and kept taking advantage until corporate figured it out. But it seems a host that knows exactly what you were doing has just stepped in and saved the company some money.

    Good luck suing on that. If you never deviated from your level of play, and you booked a legit offer but a vindictive host just canceled it on you out of spite I'd be with you on being mad. But when your host keeps telling you you are not playing enough (assumingly for the offers you are taking) and by your own admission you are no playing them. With your only defense being "Well marketing sends offers so I'm taking them". I think we found the problem.

    From a legal standpoint, no offer is guaranteed. They have verbiage like the below to protect themselves from players that gamble high to get offer, and then just cash in those offers and walk away without playing.

    "Offer is expressly conditioned upon recipient maintaining historical level of play"

    You "No Played" and got caught. It happens. If you could use one great offer forever and not have to gamble a dime while doing it, the casino industry would be bust. I wish it worked that way. But it doesn't. Playing high one day after all these zero days does not get you out of a hole.

    The "no played" part would explain the casino's actions, except why did they still keep mailing out marketing offers to the OP. Being "no mailed" is usually the quickest and easiest way to cut off someone that the casino feels is abusing comps and offers.

    OP did not name the club or casino. So I posted a generic assumption in my reply

    I'm sure those corporate offers will be cut off as well. The "system" just hasnt figured it out yet. Its not like one guy goes thru a checklist on who gets what and when. Its all done by a computer and who knows what they programed it to look for. It might very well keep chopping the ADT down each month.

    $20K coin in would trigger the free food and free play. OP no plays them after using it twice (and logging 2 visits) So now the computer might reduce the coin in per day down to $7K ($20K div by 3). Which might be good for 2 nights VS 3 and less free play. All the way down to an average that wont generate comps. But it takes time.

    A human can say "Hey, this guy is stealing from us, cut him off" but a computer usually just looks at math.

    My local Indian Casinos takes forever to update their offers. Strong play can take months before seeing your offers go up. And on the other side of the coin, I know people that will get free play and free buffets for months with zero play until they get cut off.

    I'm sure, to the OP's credit, they could probably still walk into their local casino, with these still flowing corporate offers in hand, and grab a free gift, the slot play and free buffets as well. Those are all usually paper offer (mailers). And most casinos wouldnt want you to make a scene "What do you mean you wont honor my coupon for a free toasters!?!, You take my money and wont give me what you promised?!?!"

    But what they can do is not honor any more free rooms or offer to take off back end comps. Which it seems is exactly the route they took after being alerted to this by a host. A host that watched the player take and not give.

    Thanks so much for all the replies. I will gladly name the host, and casinos involved if permitted.

    Yes i have had a lot of low play, or no play. These offeres have been going on at this particular casino from the end of 2013 when i had a huge loss. Till this year. In between not much play, until last month i put on 15,000 points.

    My biggest thing is. This host doesn't even work at this property. I feel she is harassing me. I haven't dealt with her in years. She always harassed me where she worked. So i took my business to other properties. I did return to the property where she worked a few years ago. Was assigned a different host. Never heard a peep from him.

    Thanks for the legal information as well. I just wish there was some way i could be like look, i gave u businesses all these years. Now I'm treated like this. That's uncalled for. You can't treat customers like this. Just cut off the offers. Don't cancel after i have a confirmed reservation

    The casino where I got my reservation cancelled is Sunset Station. The hosts name is Toni. She works at Palace. She is an awful and incompetent host.
