Fake ID

    Even if they call the cops, there's nothing saying she has to stay there and wait for them. Even in casinos, security can only restrain you while the police are called if you are believed to have committed a felony, which this is not. So if they say "nope, this is fake...we're calling the cops" she can say "good luck getting them here before I leave". If they restrain her, that's false imprisonment.

    I see a couple people mentioning the daughter just going in and not drinking, being the DD, going in and slipping drinks from the adults. If they're ID'ing at the door, don't you need to be 21 to enter? Is this a bar or just a restaurant?

    To me, if they're ID'ing at the door, you're not getting in by saying "I won't drink". If it's a restaurant and waitstaff or the bartender IDs, then "not drinking" is an option. Maybe I'm not understanding what these folks are saying.

    I'm torn on the OPs question, however. On one hand, I strongly suspect if the ID is suspect, they'll just deny entry. It's hard to imagine them calling the cops and turning it into a hassle for something they must see all the time. But if she gets hammered and makes a scene, then she likely has a problem. On the other hand, as others have noted--you're out of town, on vacation...if they DO decide to turn it into something, will it have been worth it?

    And I'm certainly making no judgments. I live in Wisconsin. I lived in a small town. I drank underage, I served those who were underage when I tended bar. To me, it's no big deal. It's really about how much risk you're willing to take. Here, at a small town bar? The risk is next to none. I only denied an underager I didn't know and didn't have ID. I never confiscated a fake in my life, just booted them. In Vegas? It's hard to say what the risk really is.

    Seems the OP abandoned this thread as soon as it was opened. Not sure if it's serious, or just really bad trolling.

    In any case, you should totally go for it. It's totally going to be worth any sort of hassle, fines, court fees, or appearances she and/or you would have to go through. Why not? Laws are made for other people and don't apply to your situation. You're in the right here.

    Cmon, there is almost no chance that a kid with even a blatently false ID would face anything other than denied entry. Trying to sneak into a club without proper ID will not lead to prosecution, lawyering up, incarceration, hard labor, and a ruined future.

    Not sure what the drinking laws in Vegas are but in Florida anyone caught serving a minor is arrested, cited, fined and given a court date. Just a side of the argument no one has presented.

    Really, who's identity are you stealing? Lets be clear, attempting to get into a bar/club underage is not a bad thing when you're young, we do youth a disservice when we get all high and mighty, and start acting like the over the hill fuddy duddies that we are.

    And, the OP's wife can legally order drinks and provide them to their daughter...assuming Gilley's allows it and allows an under-21 customer to enter.
    But the legality is not at issue. An over-21 parent, legal guardian or spouse may legally provide alcohol to their under-21 spouse or child... in Nevada.

    Using a fake ID is, however, clearly illegal.
    I think his choice is clear here. Call Gilley's & ask them if they'd be ok with it. Have the Nevada ordinance handy if they try to claim that it's illegal.

    If you use someone elses ID...someone that looks like you, then you are claiming to be that person...identity theft.

    I would have her attend the parties that don't require getting through a bouncer at places like Heart Bar in PHo, Napoleon's in Paris, or really any of the center bars or lounges. Worst case scenario, a waitress asks to see an ID, but she will pay much less attention to it than a bouncer would.

    I have seen numerous people try fake ID's in Vegas for drinking, and I have never seen security or police called, the bouncer, server, manager, or whomever always just makes that person leave or deny entry. Some even laugh and say nice try. Gambling however, I did see a dude get his head smashed against a 3 card poker table at Mirage for using a fake ID...

    Don't know what fake IDs are like now but years ago had a friend who was a couple of years younger than me so he had a fake ID to go to Vegas etc with me.
    It was his ID with his picture but it was altered.
    I don't think he was stealing anyone's identity.

    It's not identity theft. In Nevada, using a fake ID for the purposes of appearing old enough to drink or gamble is only a misdemeanor (as mentioned earlier in the thread).

    There is a difference between using a "fake ID" and using the ID of someone who looks like you but is of legal age.

    If you have a "Fake ID" made, with your picture, name, address, etc...with a different birthday then you are not claiming to be a different person. If you use the ID of someone else who looks like you, but is older, then you are claiming to be that person...you are claiming their identity for yourself. If the bouncers were to question you on the ID, and asked what is your full name...if you gave that other person's name as your own...then you are attempting to steal their identity

    I don't really if they use a fake or not. I've always thought the age of 21 is rather stupid. They won't go to jail, it isn't a felony, there is nothing permanent about it. As for altering a fake id or creating your own, don't do that, I'm pretty sure that is a felony.

    I wouldn't use it for gambling just because I feel the casinos are more careful in that area.

    I'm not a huge fan of someone using a fake id around their parents though. It just seems like the parents could be in more trouble than the kid if it was ever found out.

    If the parents are cool with their almost 21 year old having a drink or two around them, then fine. Order it for them, and call it good (assuming the establishment isn't going to care). But to consider encouraging your 20 year old to use a fake ID in your presence, and then going to a forum to seek validation for said decision, to me, just seems kinda........... trashy.

    This is easy.

    Have the 20 year old order a coke or something. Have someone else at the table order a shot of rum or vodka. When the waitress isn't around, pour said shot in said coke.

    Boom, mixed drink.

    Worked for us all the time when we had under agers in our group.

    Again, who said that's what was being done? A "really good fake" could be an altered version of her own DL.

    That assumes they admit her. Most bars and clubs, the "parent of under 21 child" rule notwithstanding, won't admit anyone under 21, regardless of what they "order". (Here, we also have the "under 21 is ok if accompanied by parent/guardian/spouse over 21" rule but most sports bars and clubs ID everyone and don't admit anyone under 21 because the rule is subject to the operator's discretion).

    I do like the idea of just calling ahead and see if they allow it. If not, the next best option is to go to place where they don't card at the door...then use the "order a Coke for the daughter and an extra mixer" trick. Then if they card, you say she doesn't have it and she gets bounced, nbd. The next best option is to use her own altered ID vs using the ID of another person, because the latter is a citation or charge for the person using the ID and the person providing it (in most cases).

    We don't know what the fuck the OP is doing, or what "fake" ID even means to them.

    I was pointing out that using someone else's ID is identity theft...
