Injured on Casino Property?

    My co-worker slipped and fell on wet ground just outside Miracle Mile mall. Only pride was hurt from that fall. At that time there was a webcam that overlooked the area where he fell. I told him about that camera and that it is likely people saw it happen. His pride was hurt a little more.

    I'm still amazed at their nonchalant attitude that they displayed...even more than that - abrasiveness toward me.
    I'm not the kind of guy who takes legal action over stuff like this, but it really would have been nice if they had shown at least some level of concern over the situation...you know, like removing the defective chair... making sure the injury was properly disinfected & treated... apologizing for the injury... but no - nothing like that.
    Just the stern warning that I needed to be sure I didn't get any blood on the cards or chips, a couple of Kleenex, a few bev-naps... when I asked, they brought a band-aid... and when I further asked for an alcohol swab, they brought me one.
    No offers to help with the injury at all.

    ...and, yeah - I still feel slighted about it.

    you have every right to feel slighted about this.... but I bet it would have been different if you asked about filling out an injury report when you asked for the alcohol swab...or when you were told not to get blood on the cards/chips you should have said bring me the injury report to fill out while I call my lawyer!!

    I can't believe how litigious it is in the States. For me, unless I'm injured to the point where I cannot earn a living I would not sue. People love to try to get money for nothing these days. topcard, if I was treated like they treated you in the same circumstance I would be livid too. An apology and some genuine concern would go a long way to soothe me in a case like that. I still wouldn't sue (as I'm sure many would) but without the apology, what could have been a positive social media report would definitely be a nasty one.

    My son slipped and fell at the Flamingo pool like 13 years ago. We were taken to the security office and filled out paperwork. The security guard said he was also a paramedic and checked his eyes and was more “worried” about him looking dehydrated. I said that’s funny I would think you would be more worried about the bump on his head from it bouncing off the hot concrete. We watched him like a hawk the next day or so, but we did have documentation that it happened and I let them know when we made it back home if anything happened I would be getting him checked out and sending the bill. The look on his face was priceless. My son ended up being fine, so no follow up was needed.

    During my August trip last year, early morning around 8:00 AM, I had gotten out of the Uber, pulling my roller bag to the entrance at the Flamingo and ended up face first on the concrete with one shoe still in the drive, my glasses a couple feet forward. The valet & baggage guys were there in seconds calling for their medics & security.

    I just didn't see the dark curb, my eyes were focused on the light colored concrete another 8 inches past. My brain was thinking to raise foot then - big Oops. Nothing bleeding nor broken, I think I was more embarrassed than anything and just wanted to get to my room. I was having cataract surgery 2 weeks later and that probably contributed to the distance judgement, but the next day the curb was painted a bright yellow all around the curve.:rolleyes: At least I left upright!

    Nothing offered nor asked - I accepted it was simply my aged eyes. Then when I saw the repainted curb, made me wonder how worried they might have been. I'd heard of people getting knocked out of their shoes but I still can't figure how one was still in the drive:(

    Anyway, I survived, it was just an accident and it's great not wearing glasses - so much to see!

    I agree about our society being overly litigious. Everybody wants something for nothing. Unless the casino/hotel was clearly negligent these cases should be thrown out of court. I would never even consider suing because of my own clumsiness.

    Several years ago we were staying at the Peppermill in Reno and my husband got up in the middle of the night and was on his way to the window to see if it was snowing. (We were due to drive up to Tahoe the next day and snow was predicted). He fell on a huge marble table and severely dislocated his shoulder. I knew he would have to go to the ER. I had a hard time getting them to even bring up a wheelchair so that I could take him to the ER. No offer to call an ambulance and no help in getting him to the car. (He later had to have surgery at home for a torn rotator cuff as a result of the fall and spent many months in PT.) We obviously didn't get to Tahoe that trip and they wanted to charge us for the extra night that we had to stay there before I had to drive us back to LV. I did convince them to comp that extra night but that was the extent of their involvement. I have noticed on subsequent trips that those marble tables are now pushed way over by the wall instead of being in the middle of the room. Was it their fault that the table was in the middle of the room? Who knows but ultimately the fall was a freak accident.

    It's one thing when somebody sustains an injury based on their own failure to pay attention, when devices, furnishings & equipment are placed & operating as they were designed/intended to.
    It's quite another when something is defective.

    If you get into a gondola at the Venetian & it sinks, is that your fault or the property's?
    If you're walking up to the front desk & a ceiling tile falls & hits you on the head, is that due to your own carelessness?
    If you go to turn on the floor lamp in your hotel room & you sustain an electric shock, is that only because you should have known better than to try?
    If your cocktail glass shatters as soon as you pick it up & the broken glass slices your hand open, is that something you should have foreseen & besides, that what you get for drinking?

    Look, I don't even think about suing over little things, and I certainly never even considered it with the Golden Gate... but when the property asks me to move my chair over & there is a defect in the chair that causes my finger to be impaled by a piece of metal, that's not my fault - it's not me being careless - it's not me failing to pay attention to my surroundings.

    I didn't expect money.
    I expected them to be concerned that a guest just injured themselves through performing a 'normal' task at the request of said property. They weren't.
    I expected them to want to be sure that the injury was treated properly & promptly. They were indifferent.
    I expected them to remove or repair the defective chair so that this wouldn't happen to another guest. They didn't.
    I expected an apology & never received one.
    I expected to be treated respectfully & instead I was treated sternly regarding not getting blood on the cards or chips.

    In short, I was treated as if I had caused the accident & injury.

    In no way was I trying to make less your injury, nor the way you were treated. I was simply comparing the instant concern of the outside Flamingo hotel employees to the treatment you received from the GG pit employees.

    From your posts the incident occurred 5 years ago at Golden Gate. Curious if based on their treatment of you, not offering to treat the wound properly, their indifference and disrespect, and defect in the chair which they did not correct seemingly still bothers you, do you still play and stay at that property? Or did you write them off?

    I still play there every trip...I like the charm of the place & the UTH table is always fun... they also have one of the only 3:2, double-deck tables (@$15-to-$25) that permits DAS - other than the El-Co. The other one is at Plaza.

    I pretty much got over their indifference to my "event" by the next trip, so - no, I don't really hold a grudge, but I still get bothered by it when I think about it....the trick is to not think about it! ;)

    PS - I really like their "suites" & if they ever offer me another comped one, I'll stay there again.

    A year ago, I was going down the steps at Fremont, the inside ones that lead to the street, and just ran my hand down the rail and cut my little finger on the edge of it. Security was standing nearby and I asked him if they had a bandaid as it was bleeding. OMG - what a ruckus I caused -he had me sit on a chair while he called an EMT who came with a huge first-aid kit and then a manager, as well as any staff that passed by, showed up. It was all terribly embarrassing when all I wanted was a bandaid and some kind of antiseptic. They didn't offer anything other than their apologies and enough bandaids and first aid ointment to last a year. We were staying there and every time we saw that security guy, he'd ask how my finger was.

    Sorry but Caesars doesn't get to decide how long you have to file a lawsuit. That is all based on local laws and statute of limitations.

    From your story it seems like you didn't have any reason to believe that something they did caused your fall. Why were you going to bring a lawsuit?

    Because I had no idea why I fell, because I didn't feel like I tripped. I had doctor's bills. also spent about $1,500 in therapy out of pocket because I needed more therapy than the insurance paid for. I still have some pain now. Who knows if they had video on how it happened. You are assuming they weren't at fault. I had no proof either way. Also because they have insurance for things just like this.

    It would be nice for your own peace of mind to know what caused it. Seeing a video would at least provide that.

    Love this! Consequences. Accountability. Do something dumb/risky, but own the consequences if something happens due to a risky choice YOU choose to make. (Not "you" as in VMB peeps, we are pretty accountable here on owning any dumbass desisions we might make. Myself included on being able to make less than stellar choices at times.)

    Should there have been glass on the floor? No. But "no shoes/no service" is everywhere. Had she been wearing shoes, she wouldn't have been hurt.

    Now, who know if she tried to sue later on, but I am impressed with her reaction based on this... Even if she probably did have some liquid courage in her :)

    PS @topcard I absolutely agree you had every right to be livid! It's sad that the weaslers get catered to, out of fear of lawsuit, but someone like you, who had a genuine injury due to no fault of your own, was absolutely blown off and disrespected. Squeaky wheel and all :cry:

    Years ago I bought a cute tie for my attorney friend featuring pigs wearing suits, carrying attache cases, with the slogan running throughout ~ Oink! Squeal! Sue!

    Years ago I sat down at a poker table in the seat to the dealer's right (I think it was Harrah's). I was wearing shorts and the sharp corner of the drop box cut my leg. It bled like a sun-of-a-gun. They gave me bandages and solicitously inquired after my well being. Never would I think of litigation. Hey. Stuff happens.
