New news on Flamingo hotel bird killer

    I have been doing research on Justin Teixeira who killed a bird at the Flamingo Habitat on Oct. 12, 2012. He went to court on July 24, 2013 and pleaded guilty.

    Justin will be going back to Clark County, Nevada court on Oct. 16, 2013, for the
    judge to sentence him.

    There must have been some kind of deal set up because Justin is a law student
    and needed time to graduate from law school. I think that is why he will not be
    sentenced until Oct.16th.

    The news reporters are saying there are two videos of Justin and his two friends
    taking part in killing the bird. His two student friends were smart in saying they
    were guilty right away and were given a small penalty. But stupid Justin said
    he wasn't guilty of killing the bird. I think if Justin had admitted that he did kill
    the bird right away he would have just gotten a slap in the hand.
    But now it is State-wide information because I read the news from different
    States who wrote about it in their newspapers

    I doubt the sentencing was delayed to accommodate his law school. Around my parts (I'm a lawyer in Iowa and Minnesota), there is almost always a delay between a plea and sentencing to allow for a "presentence investigation," where a probation officer studies the crime, the convicted person's prior record, and relevant factors in the convicted person's life and then makes recommendations to the Court about an appropriate sentence. For example, if alcohol abuse or other substance abuse contributed to this guy's horrible decision to kill the bird, the sentence might require the convicted to go to treatment in addition to fines, jail time, etc. The study is usually done after the plea because until the plea is entered, no one is really looking into things like the convicted's educational background.

    This is a sufficiently high profile and weird case that a Judge is going to want to have a strong basis for the sentence, and gathering that info takes time.

    Further, a delay doesn't get this kid out of hot water with law school stuff. Graduation from law school doesn't mean much unless you pass the bar and are admitted to practice law. If your particular state's board feels that any crime negatively reflects your ability to honorably practice law, they won't admit you, and if you are already admitted, they'll discipline or disbar you.

    I doubt this guy will ever be admitted unless he can show a pattern of sobriety, makes amends for the crime precisely as ordered by the Court, and publicly professes shame.

    Happily, however, I have never been personally involved in any Nevada criminal cases, so my experience might not be analogous.

    I'd say the horse is long dead, but don't want to be mistaken in intent. :peace:

    Perhaps it's just time for this topic to go away. I don't know a lot of people here who condone what the guy did, but in a town as violent as Vegas in a society as violent as we have here in America, what's to be learned or proven with the Nth thread on this topic?

    Lucy, thanks for keeping us apprised of this case. I'm thinking he gets fined; has to make restitution; and, possibly probation; but, what do I know.

    I care about animals and concerned about them

    I have stayed at the Flamingo Hotel several times and each time I take great
    joy in spending time at the Habitat early in the morning and late at night.

    It is so much fun to see them in the morning when they are being fed. The little
    ducks make me laugh when I seem them stepping on top of the large koi fish
    to eat the pellets of food.

    I also have fun seeing the 3 amigos/small ducks having fun swimming together
    everywhere in the pond. Then I go to an area that has tiny baby fish that I love
    to look at.

    Late at night I like to go look at the birds sleeping. They look so cute sleeping.

    Every bird in the Habitat has a name given to them by their care givers.
    Those men killed one of their beloved pets and took joy in chasing the bird
    and playing with the head of the bird and laughing about it.

    We have a moderator keeping an eye on this thread so people will respect the
    animal lovers like myself.
    What happens in Vegas doesn't stay in Vegas. I don't plan to report back on
    Oct. 16th of the sentence given to the bird/pet killer.

    If the moderators want to close this thread they can close it. I just wanted to reach the animal lovers who do care like I do. LucyR.

    No, this three month gap, either from the time a verdict is rendered or a plea entered, is a US federal guideline and would make sense that the states adopt the same.

    This wait time is for both sides:

    For the defendant it is time for them to explore options for appeal, to investigate if there was a miscarriage of justice and to get affairs in order.

    For the prosecution this time is so they can investigate the defendant's background/criminal past, their likelihood to reoffend, any special needs for rehabilitation, research sentences for similar offenses and then compile it all in to a presentence report.

    Three months might seem like a lot of time but the prosecution does have other cases to attend to, so its all pretty much standard, legal and above board.



    That said, my own opinion:

    Even if they were putting in this extra gap so he could go to school that should still be fine.

    What the guy did was stupid, callous and a bit depraved... but what he did isn't something that should destroy his entire life.

    Having this guy graduate law school and become a lawyer, he is more likely to grow in to a decent person, to contribute and benefit society and to make up for what he did in the past than he would if he was emotionally destroyed, bankrupted, made homeless and left with no future.

    My opinion is if he gets a fine probation and community-service time he should be directed to donate his time to those cases involving animal cruelty (perhaps his fee for the "donation" could reduce his fine as opposed to straight pay). It could give him some understanding to why people feel the way they do about what he did. It may never change him but it might make him more sensitive to living creatures.

    Depending on where the individual tries to become licensed, he might not be able to take the bar exam if he pleas to a felony.

    It was a loveable innocent bird that was killed

    Time doesn't stop me from thinking about how that bird was chased and killed
    with his partner bird looking at what happened to the partner.

    Yes, the bird had a partner and now the bird doesn't have the loving partner
    to keep it company at the Habitat. Birds do have feelings. I have had birds
    as pets and they did respond to me.

    What is really interesting is that Justin had experience in working at some bird
    conservatory or something like that. I wonder what the people who worked with
    him have to say about their relationship with Justin and how he treated the
    birds. Humm....

    I don't want to see his life destroyed. I just want to see justice for the innocent
    bird. That bird will get justice from the Animal cruelty association after Justin
    gets sentenced. He will then have to face that Animal assoc. LucyR.

    The BIRD DIED IN VEGAS!

    What happens in Vegas doesn't stay in Vegas. I am home right now thinking that
    the bird needs more company. The killer should go to Africa to buy some more
    African birds to keep the African bird company. Yes, the bird was from Africa.

    It was sent all the way from Africa to Vegas.

    This topic is not dead until you all stop posting your comments. Then I will nolonger
    respond and it will be stored.

    I don't plan to come back to report on the killer and his sentence on Oct. 16th
    because most of you are not bird lovers. LucyR.

    this is a crazy story and these men are sick and twisted.they probably chop up people and store the body parts in the fridge. they should get the maximum penalty under the law no garbage about being nice to them with a slap on the wrist. that is why sick people get to do worse things because the system just slaps them on the wrist and treats them like delicate flowers.

    "It's just a bird" people say. Yet they fail to embrace the un-civil, barbaric, disregard for things living that is really the issue here. The behavior.

    Our society is slowly eroding and becoming in-sensitive, and self serving. Common decency is becoming a thing of the past. Maybe it's considered un-cool nowadays, who knows?

    Maybe the men felt that because it's just a "bird", let's get our drunken kicks out of senselessly killing it. After all, it's just a "bird".

    Seriously, would any of you care to be associated with someone like that? Doesn't that kind of thinking and behavior bother you?:peace:
