Being overserved alcohol

    So I don't hijack the thread of a waitress testing a gambler's sobriety by giving him a virgin drink...

    Legally, the casinos are obligated to cut off a drinker who is intoxicated. In reality, abiding by the law would devastate Las Vegas. We have seen a story or two about a gambler not paying his marker based on the argument that he was overserved and too drunk to make reasonable decisions. There is no question a patron should be able to recognize his/her own tipping points of buzzed to drunk to wasted. There is no question alcohol can cause unreasonable decisions/behavior. There is no question that bars and bartenders around the country have been found legally responsible for the damage a patron has caused when being overserved.

    What do you think about this huge gray area of responsibility between customer vs. business?

    I think specifically in Las Vegas, cops and judges would be politically cutting their owns throat by charging a casino with overserving. The state has too much revenue riding on gambling and alcohol. If they took away excessive alcohol the gambling and clubbing revenue would significantly drop. It could turn Nevada into New Mexico. I think the Good Ol' Boy network completely turns a blind eye for the good of the state.

    I thought the guy lost that case, want to say it was during the super bowl or nye, was DT. I hangout at the GG and have witnessed multiple times where they have cutoff a customer, most of time kicking out.

    I'm an exception to the norm, but I play ripped 99% of the time, not black out drunk but pretty hammered. I'd never blame anyone else for my decisions, much less the casino.

    People should hold themselves accountable for their own actions, but that's a lost art these days

    As with everything in Vegas, it depends on how much money you lose.

    They love whales that donk off millions while flat wasted even though they berate the dealers with every loss. The dealers hate them but the bosses just keep them served and playing.

    But if you're at the $5 table they'll kick your ass out fast if you get obviously wasted and belligerent.

    As far as the guys not paying their markers because they were over served, that really only applies to TTOs given while drunk and has resulted in markers being thrown out by the courts.

    But there's also markers that have been thrown out by the courts with no alcohol involved but when the casino extends extra credit even though they should have known the guy had no way to pay that much. Like where they gave 250k in credit to a guy that had no history of ever having more than 10k in his bank account.

    if you have to ask you really dont want to know but shifter can explain it better but basicaly say you have a credit line of 50k and you loose it , they will give you a tto of 50% sometimes 100% of your credit line during your trip

    so if you loose 50k and you ask for a tto they approve you for another 25k marker

    Stands for "this time only." It's supposed to be a one time extension of a maxed out marker usual given for an amount less than the initial marker.

    I witnessed a guy at Palace Station crap table.
    He was pissin' thru markers + they were serving him as fast as
    he could swallow.
    The guy was bombed .
    He was sweating profusely - he had a towel draped around his shoulders
    to wipe his sweaty face.
    Sweat streamin' down his face .........and he just kept losing.
    They knew his name....and kept giving him markers.
    I had never seen anything like this before !
    A real VEGAS MEMORY !
    I never left the crap table til the guy finally quit.

    Who cared if he was "overserved" ?...........maybe, his accountant ? when he got home ?

    TTO stands for this trip only.

    it's just a further extension of credit on top of your previously established CL/FM.

    the 50% limit is one of the things they generally do to keep themselves from getting into trouble.

    when they've gotten in trouble with the courts is when they TTO a guy from 20k to 200k in one visit and the guy has no history of playing to that level or any history of having that much money available.

    If you need to ask for a line of credit from a casino you need to pack your bags and go home.

    I always thought being overserved alcohol was a given plus of Vegas. I like being wasted and gambling. I'd never take credit from a casino though. I have enough debt as it is.

    so there's no confusion:

    credit from a casino is basically just check-writing privileges.

    it's for convenience.

    they're not in the loan business.

    it's only given with the understanding that you have the cash available to pay it.

    but it is free money for 30-60 days with the added convenience of not having to do anything if you don't lose.

    Wasn't this part of the problem though? People being given markers that they don't have any real way of paying without selling their car/house/etc (if they lose)? My apologies if I have misunderstood.

    No. When you apply for a LOC, you don't have to disclose all your assets. The app generally asks for your name, address, employer and income. They also want your banking info. They will run a check on your bank account and now much you have in your checking account. A marker is essentially a check. If you sign a marker and don't pay it in the required 30 or 60 days, the casino can present it to your bank for payment. A casino has never asked for details on my house, cars, boats or brokerage account. They didn't even want dets on savings accounts.

    most people don't actually own their car or house, so that wouldn't really help.

    out of the gate with no history you're only going to get a CL that your bank account can support.

    but, yes, if you have a good history of payment over lots of time, the casino will be open to putting you in a position that you can get yourself into trouble if you want to do that.

    if your Central report shows quick pay on a 200k loss, any casino on the strip will open you up at 200k in 1 second without any further check whether or not you actually have that money right now.

    it's a conundrum really. they need to extend credit to help people play more and bigger, but don't want to extend so much that they don't get paid. they're always trying to strike that balance and sometimes they don't give enough and piss people off and other times they give way too much and end up in court.

    Two words, Personal Responsibility. That's part of the problem with this country now a days, it's always somebody elses fault!!!! If you can't handle your booze, don't drink, if you can't control your drinking, don't drink. If you can't control you money when you gamble and drink, then don't!
