My First Car Accident That I Caused

    I'm age 60 and have been driving since 12.
    Yeh...that's right 12 !!!!
    This was the first accident I caused ---
    *
    I'm cursing my boss for this one !
    She calls me in for snow removal after the snow is sticking.
    I've explained to her MANY times previously....this is too late + dangerous for me.
    She doesn't want to pay me any extra O.T. ---
    and I've said, "I won't charge you, if i arrive early...only when I start to shovel."
    I commute 45-50 mins to work on a clear day.
    I get about 6 miles from home and the roads are REALLY BAD.
    I've got 50 yds ahead to a red light + a car sitting at the light.
    Light changes.......I'm doing 30 mph ( at most ) on a flat straight away.
    Car at green light doesn't move.......doesn't move.....doesn't move...
    finally, I have to hit my brakes.........and I'm on solid ice.....
    IN SLOOOOOOWWWWW motion I smack into this guy's rear end.

    Cop was right there --- ( in hindsight I realize - the cop must know this is
    a bad accident spot )
    I ask cop "Aren't you going to ask me what happenned ?"
    He said, "I saw it....you were probably going too fast."
    I said "Too fast for road conditions BUT NOT SPEEDING and did you see
    the guy was stopped under a green light ?"

    Just then
    A truck wipes out a road sign + spins ---
    exactly where my car slid.

    Anyhow,
    Can I dispute this cop's version if his report says I was speeding ?
    ( hey...I know i ain't gonna win.....and i did hit the other guy.
    My new car front bumper cracked ....but it could have been much worse.

    I'm just pissed at my boss
    I called her from the accident + told her about it.
    I missed the next day of work with a sore ankle + she
    NEVER has asked me about the accident or my ankle.
    Can we say "bitch ?"

    I'll sit in front of her BEFORE the snow begins !

    I can't believe how much adrenaline I had pumpin' thru me
    when the cop asked for license + registration.
    WHAT A RUSH !!!
    I told him "Sorry. I'm really AMPED right now !"
    I didn't even feel my sore ankle until later.

    sorry man but you did violate the basic speed law that supersedes the posted limit

    challenge away, but the judge or magistrate will talk the word of a state certified speed expert (cop) over you 100 out of 100 times

    Did the cop give you a citation? Sounds like a simple weather caused fender-bender to me.In court it may help to have a picture of the downed road sign,other mishap as proof that you or anyone may have slid anyway doing just 10mph..You can't tell if there is ice under the snow or not.

    no worries other than your deductible and possible insurance points for causing the accident...

    Yeah, I think you're out of luck.
    My Dad was telling me about a guy who got a ticket for driving in a mountain pass. They closed it while he was on it. Got a ticket for no chains on the tires. Driving in unsafe conditions is what it was for I think.

    And, you're right. It could have been a lot worse.

    No....I wasn't issued a ticket.....forgot all about that ?
    So I'm cleared on that aspect ?
    Cop mentioned "pick my report up at police barracks."

    Man, that happened to me too, except the other way around. A 20 something slammed me from behind while I was stopped at a light on very thick ice. I saw it coming in my rear view mirror when he was about a 100 feet away. I thought "That car is not going to stop in time". The light was red but in a split second I realized I better move to at least lessen the impact.

    When the kid got out of his car, it was clear he was pretty stoned. This was before cell phones, so the best I could do was exchange info. He had Florida tags and a Pennsylvania driver's license. I knew this was not going to turn out well.

    He told me his father was a lawyer (oh, no) and would send me a check to cover the damage (double oh, no).

    Anyways, I reported it to my insurance company anyway. The father/lawyer calls me up all irate and starts calling me a coward, pussy, blah, blah, blah.

    He said he will make sure I never see a penny of my money.

    I called my insurance company and told them of his threats.

    Flash forward 4 years. A check from Allstate appears for $850. Although happy for the unexpected windfall, I called Allstate to ask what is was for. They said they had finally settled the accident from 4 years previous.

    I didn't understand, and 25 years later I still don't, but somehow that sonofabitch tied up the settlement for 4 years.

    Tying something like that up for 4 years doesn't seem worthwhile. Something tells me you weren't the only one that kid had a run in with. Daddy tied things up in court to delay things so it didn't hit the kids record all at once.

    Joe, I do a lot of accident law for a living and you don't have anything to worry about from a criminal/citation aspect. cops rarely issue citations for MVAs (unless it is a DUI). The cop was saying you can pick up the accident report. Your insurance may want to see that. The other driver, however, may have a claim against you. If all the other driver suffered was property damage, its likely your insurance and the other drivers insurance will work it out. If the other driver also had injuries, its a different story. In that case, your insurance will provide an attorney (well, a very cheap attorney) to represent you. 90% of those disputes settle without going to court. if, however, it does not settle and it goes to court, the cop will end up being a witness for the other driver and that is difficult to overcome. Judges and juries give significant deference to cops.

    The cop can't use "probably going too fast" in the report. It's just speculation with no evidence. Regardless, a rear-end collision is the fault of the person who did the rear-ending unless they cut you off. And even that requires a witness. I hope all are uninjured.

    Joe, sorry to hear of your fender bender. But it seems to me you have a much larger problem: Your boss. She sounds like so many ill-suited management types in that they expect loyalty but return none. Hope you get the opportunity to work for someone better than her.

    A tip for people who are not used to driving in icy conditions, at slow speed. When you want to stop or are going down hill at slow speed and want to use your brakes "put your automatic transmission in neutral".

    I know it's easy for me to say ,but it's one of those "chalk it up " kind of things. You cant change it and for what it';s worth at least nobody got hurt.
    Your boss,I know how you feel ,you have to deal with her the best you can, Good luck,maybe you'll be rid of her one day.
    I told one guy "dont worry about me pissing on your grave after you die,I hate standing in long lines to pee".

    I was in one of the slow motion four car accidents on ice one year. I was going slow also....when I turned onto the road, I realized it was pure ice. Slowly made the curve in the road to then see that a truck was stopped to turn left, two cars were behind it and there was nowhere to go.(They had just installed curbs on both sides of the road and there was a grass median) I hit the one in front of me and they all slowly were pushed into the one in front. There was no way to avoid it and I was to blame because I wasn't "driving for the conditions and in control of my vehicle".

    But, my son was in an accident - someone pulled out from a gas station and my son was going straight. When we received a letter from the insurance company that stated it was my son's fault, we called the insurance company and explained what had happened. They then, in turn, went after the other driver's insurance for the claim. So, if you ever feel you were not at fault, call your insurance company and see what they can do.
