Bellagio dealer sues after she was severely slashed on face in casino

    Rhone's lawyer, Harold Gewerter, told The Times that the Bellagio must be held accountable for not rushing aid to a gravely wounded employee. "If you count cards, five people will jump all over you, and that's not even a crime," Gewerter said. "But here is a woman who is wounded so badly she has to hold her face together and nobody does a thing."

    "People saw her. The pit bosses, they stood and watched like it was some horror film," Gewerter said. "After the victim crawled several hundred feet, a cocktail waitress finally leaned in and asked 'What’s going on, dear?' Then Ms. Rhone collapsed. The next thing she remembers is being surrounded by paramedics and cops."

    crawled several hundred feet through a fancy crowded casino bleeding and no one helped her?

    How did she hold her face together and crawl at the same time?


    How long do you realsitcally think it would take to crawl that far? 20 minutes?

    No one has a cell phone and there are no security cameras in casinos?

    I have major problems with this story.

    She got help and she's not dead, no need to go on suing now.

    Nice compassion! With that logic, she shouldda been required to be back on her next shift... bandage it up and start dealin'! Geeze!!! Having your face carved up by a box-cutter... Ughhhhhhh

    I've read a bit about this and it'll be interesting to see what a court does... apparently off shift employees are NOT to be on the floor, yet the other dealer who attacked her was seen talking with other employees and supervisors for awhile before the attack. Also, it doesn't surprise me that there was a slow reaction to her after the slashing, I'm sure many were in pure shock and other may not have seen or known what went on. Let's not forget, she was attacked at work.

    I'm not sure what Bellagio staff, supervisors, etc. could be expected to do. They're trained to protect the chips, etc., but what training is reasonable and what actions are reasonable in a situation like this? I dunno... we'll see what a court says.

    The courts though, are not supposed to feel compassion. There's a reason Lady Justice is blindfolded. So hopefully the court rules accordingly. As a property owner myself I can't tell you the amount of times people turn to me as the thickest wallet. Twist your ankle because you "fell off the curb"? Sue the owner. I once had a guy threaten to sue me because he ran his car into my building. Claimed my barrier was not an appropriate height. I actually offered to pay for everything, including rental but refused to pay for the gas he would have spent driving around during that week. He was unbending. He dropped dead 3 weeks later. Couldn't have happened to a nicer person :faint: . Rant over. Sorry, I go off on a tangent when people reactively sue property owners. The article makes it sound bad, but think about who is telling you this horrible story, HER ATTORNEY.

    Let's hope the injured party has her day in court against her attacker and justice is served.

    I'll bet the civil part of this case (against Bellagio) will be settled out of court.

    Why is she sueing Bellagio and not the person who slashed her face? For the simple fact that the assailant has no money. So, she looks around and checks to see who has deep pockets and voila, all of the sudden, the B is the defendant. Lawyers select defendants not on the basis of their culpability so much as their ability to pay a judgment.

    Not shocked about the lawsuit. The argument is odd, though. When I saw the title, I assumed the argument would be on overall security considering some of the high profile incidents at the B.

    they don't want a judgement. they want the casino to see how much it would cost to defend and offer an out of court settlement to save the hassle.

    one look at the videos would see exactly what happened.
    The only way it ends up being settled after a judgement is if the lawyer refuses an offer or the casino is adamant it is not guilty at all and has evidence that will back them up.

    Sadly, having worked in the insurance industry, some courts don't give a damn about facts - they'll find the deep pocket defendant guilty anyway.

    Bellagio should not settle. Make a stand, even if it costs more than settling. It will prevent future frivilous lawsuits, even if this one turns out to be valid. It will save money in the long run.

    Five guys jumping a card counter? Sounds like grandstanding to me.

    I would have been one to back off a grotesque injury like that. First, I am not a medic and haven't been trained to help. Second, because I'm not a medic I don't want to be sued for doing something wrong in treating an injury like this. Lawsuits like this are part of the reason people like me don't help. I know there's a Good Samaritain law where I live, but I don't know if there's one in Nevada. I wouldn't have helped either.

    And I'm assuming casino staff are trained to let each department handle their responsibilities. Dealers and bosses are not going to leave the tables for any reason. Security is going to stop the threat, subdue the attacker. The tapes will show that medical help was called immediately. This casino employee knows this.

    Workman's comp will pay the medical bills. The scars are going to last, and they're going to remind me to choose well the people I associate with.

    They tried to make it sound like she was bleeding on the floor for 5 minutes before anyone came to her to try to help her, when it was probably 30 seconds. The dealers can't leave their tables, so she'd have to wait for the pit staff or security to attend to her. And it isn't like if they somehow 'attended' to her in a split second her injuries would be any less.

    The only guilty party is the attacker.

    She's not dead, so move on huh? How self centered. I'm certain that if it had been your wife or daughter that had her face slit with a box cutter and left with facial scaring the rest of her life you'd just say "she's not dead, move on..." Bullshit. You would want someone to ask the right questions. Maybe there is culpability on the part of the B, and maybe there isn't. But no one will know until its investigated. And if it were your family, you wouldn't want to rely on the one sided investigation peformed by the B. You know how that will end. What if for example this same employee had been voicing threats to co-workers or even supervisors about being upset or threatening violence and they did nothing to take her off the floor. Worse, they left her next to your daughter and said tough?! I have no idea if that's what happened, but unfortuatnely unless you are relying on the B, the only folks who will look into these things for you (unless you are able and choose to pay an investigator hourly) is an attorney who will do so for free. So, you are saying you wouldn't ask for this help? Bullshit. This is the same attitude too many people have. Do what i say, not what i do.

    Two more things:

    true story, a good friend of mine sits in the Georgia legislature. a few years back we had real medical tort reform which severly limited non economic damages. What this means is that if you a high income earner and you get hurt by a doctor, your life is worth a lot, lot more than a house wive's. So anyway, after it passed a republican legislator who sat next to my friend had his daughter gravely injured in a bad malpractice situation. so, when he and the family went to an attorney he learned their new law actually applied to him and his family too and he was besdie himself. His daughter was a young beautiful mom without a job. Her life/health was worth $250k, not a cent more. The point is what sounds good isn't so good when it also applies to you versus the masses.

    Second, this lady's claims against the B are almost certainly barred by the workers' comp doctrine. Meaning she will have her medical bills cared for and 2/3 of her weekly income so long as she is unable to work which won't be more than a few weeks given then nature of this injury. Maybe a good and eager lawyer will get her scar revision surgery in a few years. She will not get a penny for pain and suffering under the law of most states, and i have to presume Nevada is like most other states.

    This thread was making me squeamish but I resisted posting because I know myself and will probably end up saying something that'll get me infractions from the mods. It amazes me how people are so quick to pass judgement on someone's case without any detailed facts. How quick people are to describe someone as being "sue happy" and argue David should suck it up while Goliath deserves a pass without really knowing anything. So quick to strip the average person of any justice while protecting corporations from having to face inquiry. This is a barely middle class lady whose life got turned upside down after a violent attack on the job. Maybe she has a real claim, maybe she doesn't. But let her have her day in court and stop buying into the rhetoric that's made it harder and harder for actual people to get justice versus corporations.
