Assault at MSS, victim sues MSS

    Surprised that it took so long for the guy to sue MSS. This incident happened 2 years, in may of 2010.

    The perp got 10 years but could be out on parole already (eligible for parole after 2 years).

    Too bad for the victim. I know the area, it is probably in the restroom with the berlin wall. They spoke about the long hallway to get to the bathroom. The only other restroom is by the front desk (no long hallway) so it's gotta be the one by the buffets.

    we hardly hear about these assaults at vegas hotels. My dad got mugged walking from the lady luck over 13 years ago. Not a mention in the paper or anywhere. the mugger hid behind a van and caught my dad by surprise.

    Wow - that is awful, never heard that story until now.

    I feel terrible for the victim.

    Oh it is certainly the long hallway to the Berlin Wall bathroom.

    They may need a camera or a guard there somewhere. (in the hallway that is...)

    I feel very sorry for the victim, but really what do you want, cameras in the bathrooms? I don't.

    The casino has 5 main entries. 1 north, 2 east & 2 south, plus the walkway from The Cal, to enter the casino.

    A guard at every entrance and then what? They decide who looks goofy and should be stopped, or prevented from entering because he/she looks funny?

    A tragic incident but it sounds like an ambulance chasing lawyer looking to make some $.

    I don't see how the casino would be found at fault.

    While the story is a tragedy, I'm not sure what MSS could have done, within reason, to prevent it.

    I mean, they could have guards at the doors or security in the hallway by the bathrooms, but there is no guarantee that would have prevented the incident.

    I know what you mean, there are already cameras down the hallway and I doubt it would be cost effective to put someone in the bathroom. Then again, maybe a guard at the entrance to the hallway maybe?

    I think the guy and family probably want some compensation for their pain and suffering. I doubt it would get much further, probably some kind of out of court settlement that is sealed.

    It's just unusual to hear of it, I'm sure it happens at other hotels but I guess they are good at covering it up or settling before it get out in the news.

    I remember when I lived in Kansas City there was a guy who mugged an older lady at a casino and ran off with her purse and it was caught on camera. After seeing the video on the news, the guy was turned in by someone that recognized him- his own mother. :nono:

    I have no time for people like this.

    Although I feel for the victim in this crime, I don't see why MSS is the one at fault.
    Clearly, it was the person who committed the crime.

    The 2 years it has taken to sue MSS is the civil trial and they do take a while to get to court.
    Litigants generally wait til the criminal charges and judgments have been made before moving onto civil trial.

    I'm sure the lawyer representing the victim was looking for a way to find him some restitution in this awful situation.
    MSS would be his best bet, as I'd wager the homeless person had no financial way of repaying this man for
    his pain and suffering, as well as medical costs.

    Sadly, this could have happened in any public restroom, just about anywhere.

    The article states the homeless man was allowed to "wander into the casino unimpeded".
    Huh? Don't most of us do this at any given time at any given hour when in Las Vegas?
    I'm pretty sure we all look a little dodgy at 3 o'clock in the morning, no matter what our social status.
    The attacker was wrong and should pay for his crime but it wasn't MSS fault he committed it.

    Of course, the insurance company and attorneys representing MSS may tell them they have to assign a guard at the restroom entrances from now on...but that will be in reaction to the suit and the possiblity of higher premiums (and/or civil judgments) but not because it was negligence on MSS part.

    It seems they are trying to argue that the casino should have never let the guy in because he was homeless. Unless they can prove he was known to security and had harassed people before, that may not be a good enough claim. Being homeless doesn't mean you can't patronize a business. Just not seeing enough to expect much back from a jury.

    He was homeless with a criminal background. I agree with the case, if this was me id be pissed. MSS should have had better security.

    In AC, anyone homeless is removed off grounds instantly. They are walked out the door by security. I feel bad when its cold out and they try to sneak in. I have seen some homeless drunks cause trouble for no reason either(racist comments) randomly on the boardwalk.

    Hookers are escorted off hotel properties.

    I do think MSS is at fault, its up the the lawyer to prove it though.

    I dont see how MSS could be found at fault, unless a similar incident had happened in the past. I dont see how a casino could be held liable for anything that happens on their property, unless it is shown that they were aware of a dangerous issue, and did nothing to correct it.

    IMO, things like this can, and do, happen everywhere. Could just as easily have happened in the Costco bathroom.

    MSS is totally to blame.

    They should have security at every entrance, fully trained and able to:

    Look at a person and know that they are homeless:
    Look at a person and know that they have a criminal background:
    Look at a person and know that they intend to commit a crime:

    obviously they failed to provide and train the staff to do any of that therefore they totally deserve to be sued.

    Over the years I've been summoned 4 times. Got put on a jury twice, but mostly it is just sitting around waiting.:cry:

    The last jury I was on, we heard testimony for 3 days and both sides rested. We went into deliberation for a couple of hours and the judge calls us back..."thanks for your service, but the parties have reached an agreement".:grrr:

    Unfortunately there are victims of crime all over our country, too bad we have such losers in society who do things like this, however MSS should take every precaution possible, in economic hard times for many these days, they don't want to have they're business hurt by something like this, although it's not they're fault, they should perhaps have more security, especially where crime could be more prone to happen. The article stated that many Hawaiians/clientele stay at MSS.

    Not exactly sure what that has to do with this. Nevada ranks #24 in violent crime, and Hawaii is #43. Less violent crime, but as you stated, it happens everywhere.
    The worst state in the country is CA.

    I was only stating the fact of the article! The victim was from Hawaii and it was stated over half of the patrons/guest/clientele, that stay at MSS are from Hawaii, we weren't talking about Hawaii's crime, the article was about what happened to a victim in Las Vegas that was from Hawaii. It had everything to do with it, JMO.

    I guess I'm not following your logic. Would it have made a difference if the victim was from Minnesota, Wisconsin, New York, or any of the other states?

Here is my post again below! What was the content of my first sentence?????????????????? gawd and just to think on another forum I said I would try to refrain my mouth before my upcoming trip to Vegas! I'm not doing a good enough job right now! Hold on I need to get my &%$#@*& Estroven! anyway my post below again!
